These Terms of Service and SMS Terms & Conditions (“Terms”) govern your access to and use of the Shoeless Performance LLC website, forms, communications, digital resources, products, programs, coaching services, and text-messaging program.
“Shoeless Performance,” “we,” “us,” and “our” refer to Shoeless Performance LLC.
By accessing our website, submitting a form, purchasing a product or service, or participating in one of our programs, you agree to these Terms. If you do not agree, discontinue use of our website and services.
ABOUT SHOELESS PERFORMANCE
Shoeless Performance provides fitness, performance, coaching, educational, motivational, and related informational resources. Available programs, features, pricing, and services may change at any time.
ELIGIBILITY
You must be at least 18 years old and legally capable of entering into a binding agreement to purchase or participate in our paid programs unless participation is expressly authorized by a parent or legal guardian.

PROGRAMS, PRODUCTS, AND SERVICES
Descriptions, pricing, availability, features, schedules, and terms of programs, products, and services may change at any time.
Additional written agreements, payment terms, cancellation policies, refund policies, coaching agreements, or program rules may apply to a particular purchase or service. If a specific written agreement conflicts with these general Terms, the more specific agreement will control.
You agree to provide complete, accurate, and current information when submitting forms, purchasing products or services, or communicating with us.
PAYMENTS AND REFUNDS
When purchasing a product or service, you authorize Shoeless Performance and its payment providers to charge the payment method you supply for the amounts and payment schedule disclosed at the time of purchase.
You are responsible for maintaining accurate billing information and sufficient funds.
Cancellation rights, recurring payment terms, and refund eligibility are governed by the specific offer or service agreement presented at the time of purchase. Except where otherwise stated in writing or required by law, payments are nonrefundable after the applicable service or digital product has been delivered.
Failure to participate in or use a purchased program or service does not automatically create a right to a refund.
SMS TEXT-MESSAGING PROGRAM
PROGRAM NAME

PROGRAM DESCRIPTION
When you expressly opt in, Shoeless Performance may send recurring automated marketing and informational text messages.
Messages may include delivery and follow-up concerning the free 7-Day Reset, educational content, coaching information, Shoeless Performance announcements, program updates, reminders, and occasional promotional offers.
OPT-IN AND CONSENT
You may opt in by entering your telephone number through a Shoeless Performance online form and affirmatively selecting an optional, unchecked SMS-consent box.
By opting in, you authorize Shoeless Performance to send recurring automated marketing and informational text messages to the telephone number provided.
Consent to receive text messages is not a condition of purchasing any product or service.
MESSAGE FREQUENCY
Message frequency varies.
MESSAGE AND DATA RATES
Message and data rates may apply according to your mobile carrier and service plan. Shoeless Performance does not charge separately for SMS messages, but your carrier may impose charges.
OPT-OUT INSTRUCTIONS
You may cancel SMS messages at any time by replying STOP.
After submitting STOP, you may receive a final confirmation message stating that you have been unsubscribed. After processing your request, no additional marketing text messages will be sent unless you affirmatively opt in again.
Other commonly recognized opt-out requests may also be honored where required.

SUPPORTED CARRIERS
Message delivery is subject to the availability and operation of participating wireless carriers. Carriers are not liable for delayed or undelivered messages.
DELIVERY
Delivery of text messages is not guaranteed. Messages may be delayed, filtered, blocked, or undelivered because of carrier systems, device settings, network availability, an incorrect or inactive telephone number, regulatory requirements, or other circumstances outside our control.
MOBILE NUMBER RESPONSIBILITY
You represent that you are the subscriber or customary user of the telephone number provided and that you are authorized to consent to receiving messages at that number.
If your telephone number changes, is reassigned, or is no longer controlled by you, you agree to unsubscribe or notify Shoeless Performance promptly.
SMS PRIVACY

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
Information sharing with service providers excludes text-messaging originator opt-in data and consent. Text-messaging opt-in data and consent will not be shared with third parties except vendors acting on our behalf when necessary to operate and support the messaging program or when disclosure is required by law.
SMS PROGRAM CHANGES
We may modify, suspend, or discontinue the SMS program or change its message frequency at any time. When legally required, material changes will be communicated or renewed consent will be requested.
EMAIL COMMUNICATIONS
If you provide your email address, Shoeless Performance may send requested resources, transactional messages, service notices, educational information, newsletters, updates, or promotional communications.

INDEMNIFICATION
To the maximum extent permitted by law, you agree to indemnify and hold harmless Shoeless Performance LLC and its owners, officers, employees, contractors, and representatives from claims, liabilities, damages, losses, and reasonable expenses arising from your unlawful use of the website or services, your violation of these Terms, or your violation of another person’s rights.
TERMINATION
We may suspend or terminate access to a program, product, website feature, or service if you violate these Terms, misuse the services, fail to make required payments, threaten the safety of others, or engage in unlawful or disruptive conduct.
Provisions that by their nature should survive termination—including intellectual-property, disclaimer, limitation-of-liability, indemnification, payment, and dispute provisions—will remain effective.
GOVERNING LAW
